Schedule of Arbitration Fees

(Effective as from 1 January 2020)

1.For every arbitration case, the Claimant, when submitting its Notice of Arbitration to the Secretariat of the Centre, must pay a registration fee HKD 10,000. The registration fee is non-refundable, and it does not constitute part of the administrative fee charged by the Centre according to the fee schedule listed below. 

2.Where the parties have not agreed on the payment standard of remuneration to the arbitrators, deposit for arbitration fees shall be paid according to the following schedule::

Notes:

1.The amount of money claimed by the Claimant shall be deemed the sum in dispute as set forth in this Schedule. If there is a difference between the amount claimed and the actual sum in dispute, the actual sum in dispute shall prevail. This principle shall apply mutatis mutandis to any claim raised as a counterclaim or setoff.

2.Where the sum in dispute is not specified, this sum or the arbitration fees shall be determined by the Secretariat of the Centre.

3.Where the arbitration fee is to be charged in another freely convertible currency, the amount in that currency shall be equivalent to the corresponding amount in HKD as specified in this Schedule.

Unless otherwise provided by the arbitration rules, the remuneration of arbitrators (including the tribunal’s administrative secretary) shall be determined by the Centre, and paid from the deposit charged according to the Schedule. When determining the amount of the remuneration, the Centre shall take an overall consideration on the number of members of the arbitral tribunal, the time spent by the respective arbitrator, the disputed amount of the case, the complexity of the case, the diligence and efficiency of the arbitrators, the applicable procedure, and etc. The Centre shall determine the amount of remuneration allocated to each arbitrator within the range of minimum and maximum in the corresponding column “arbitrator’s fees of all members” as shown in the Schedule. In case the amount of remuneration payable to all arbitrators determined by the Centre is lower than the highest amount that has been collected in advance by the Centre according to the corresponding column, the differential shall be refunded to the party who actually paid the deposit.

3.Where the parties have agreed that the remuneration to arbitrators be paid according to hourly rate, deposit for arbitration fees shall be paid according to the following schedule::

Notes:

3.The amount of deposit for arbitrator’s remuneration shall be estimated by the Secretariat ofthe Centre in light of the applicable hourly rate and paid by the parties upon notice of the Centre. In the course of arbitration and upon request of the arbitral tribunal, the Secretariat may increase the amount of deposit for arbitrator’s remuneration and notify the parties to pay the deposit.

4.Where the arbitration fee is to be charged in another freely convertible currency, the amount in that currency shall be equivalent to the corresponding amount in HKD as specified in this Schedule.

5.The secretariat may charge other extra and reasonable actual expenses according to the arbitration rules.

Unless otherwise provided by the arbitration rules, the remuneration of arbitrators (including the tribunal’s administrative secretary) shall be determined by the Centre, and paid from the deposit charged according to the Schedule. In case the amount of remuneration payable to all arbitrators determined by the Centre is lower than the amount of deposit that has been collected in advance by the Centre, the differential shall be refunded to the party who actually paid the deposit.

4.Fee Schedule for Appointment of Emergency Arbitrator and Interim Measures Application  

Where a party applies to the Centre for appointing an emergency arbitrator according to Article 25 of the WAC Arbitration Rules or a party applies for interim measures made by the emergency arbitrator, the fee schedule is set out as follows:
